1. Acceptance of Terms

By accessing or using ExchangeHandles (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the new Terms. We will provide notice of material changes via email to registered users or by posting a notice on the Service.

2. Description of Service

ExchangeHandles provides a digital identity availability checking, claiming guidance, and monitoring service. The Service checks handle and domain availability across third-party platforms and provides guidance on the claiming process. ExchangeHandles is not affiliated with any third-party platform and does not guarantee the accuracy or completeness of availability data. The Service includes: (a) free availability checking across supported platforms, (b) Pro tier features including guided claiming workflows, domain registration assistance, brand kit generation, and claim certificates, and (c) Enterprise tier features including monitoring, team collaboration, and API access.

3. User Accounts

Some features of the Service require account registration. You agree to: provide accurate, current, and complete information during registration; maintain the security of your password; promptly notify us of any unauthorized access to your account; and accept responsibility for all activities that occur under your account. You may not create an account on behalf of another person without their permission, impersonate any person or entity, or provide false information. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe any intellectual property rights; (c) scrape, crawl, or systematically extract data beyond what the API permits; (d) attempt to gain unauthorized access to any part of the Service; (e) use automated tools to query the Service at rates that unreasonably burden our infrastructure; (f) engage in any activity that interferes with or disrupts the Service. The Service is provided for legitimate brand identity research and protection purposes. Using the Service to engage in handle squatting, trademark infringement, or brand impersonation is prohibited and may result in immediate account termination.

5. Third-Party Platforms

ExchangeHandles checks availability on third-party platforms including but not limited to social networks, domain registrars, and marketplaces. We do not control these platforms and are not responsible for their availability, accuracy of data returned, changes to their APIs or policies, or any actions they take regarding your accounts or handles. Handle availability data may be delayed, inaccurate, or incomplete. The Service is provided as a convenience tool; you should verify availability directly with each platform before taking action. We are not responsible for any handles that become unavailable between the time we check and the time you attempt to claim them.

6. Payments and Refunds

Pro access is available for a one-time fee as displayed on our pricing page. Enterprise access is billed annually. All fees are in USD and are non-refundable except as required by applicable law or as described in this section. If the Service fails to deliver its core functionality due to a defect on our part, you may request a refund within 30 days of purchase. Refund requests should be submitted to support@exchangehandles.com. We reserve the right to refuse refund requests for accounts that have substantially used Pro features. We use third-party payment processors and do not store your payment information. Your payment information is subject to the privacy policy of the payment processor.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ExchangeHandles and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any brand names, handles, or other content you research using the Service. By using the Service, you grant us a limited, non-exclusive license to use your brand names and handles solely for the purpose of providing the Service (i.e., running availability checks on your behalf). Claim certificates issued by ExchangeHandles are generated documents that may be used for your own brand protection purposes. They do not constitute legal trademark protection and should not be construed as such.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EXCHANGEHANDLES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EXCHANGEHANDLES DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) AVAILABILITY DATA WILL BE ACCURATE OR UP-TO-DATE; (C) ANY HANDLE OR DOMAIN WILL REMAIN AVAILABLE DURING OR AFTER YOUR SESSION; OR (D) RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCHANGEHANDLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY HANDLE OR DOMAIN BECOMING UNAVAILABLE; (C) INACCURATE AVAILABILITY DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT SHALL EXCHANGEHANDLES'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID EXCHANGEHANDLES IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting support@exchangehandles.com. Termination of your account does not entitle you to a refund of any fees paid.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
